The Foundry is a trading analytics platform that provides real time options flow data, gamma exposure analytics, equity research tools, and related features. The Service is intended for informational and educational purposes only.
The Foundry does not provide investment advice, financial advice, trading advice, or any other form of professional advice. All data, analytics, and information provided through the Service are for informational purposes only and should not be construed as a recommendation to buy, sell, or hold any security. You are solely responsible for your own investment decisions.
All content, features, functionality, software, and design elements of the Service are owned by The Foundry and are protected by copyright, trademark, and other intellectual property laws.

Account access is managed through Whop. When you create an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You agree to notify us immediately if you become aware of any unauthorized use of your account.
The Service is offered on a subscription basis billed monthly through Whop. By subscribing, you authorize recurring monthly charges to your chosen payment method.

If you participate in The Foundry's Discord community or any other communication channels associated with the Service, you agree to conduct yourself respectfully and refrain from posting spam, harassment, hate speech, or content that promotes illegal activity. We reserve the right to remove content and restrict access to community channels at our discretion.
The Service may integrate with or contain links to third party services including but not limited to Whop (authentication and payments), Discord (community), and data providers. We are not responsible for the content, privacy practices, or terms of any third party services. Your use of third party services is governed by their respective terms and policies.
While we strive to provide accurate and timely data, we do not guarantee the accuracy, completeness, or timeliness of any information provided through the Service. Market data may be delayed, incomplete, or contain errors. You acknowledge that trading decisions based on any data from the Service are made at your own risk.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error free, secure, or free of viruses or other harmful components. We do not warrant the accuracy or reliability of any information obtained through the Service.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE FOUNDRY AND ITS OWNERS, OPERATORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR TRADING LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID US IN THE SIX (6) MONTHS PRECEDING THE CLAIM.
You agree to defend, indemnify, and hold harmless The Foundry and its owners, operators, and affiliates from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. You may terminate your account at any time by cancelling your subscription through Whop.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Any dispute arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree that any arbitration shall be conducted on an individual basis and not as a class action or representative proceeding.
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the "Last updated" date at the top of this page. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
